Jared Heller – Estate Planning Isn’t About Death—It’s About Protecting the People You Love
The best probate case is the one that never happens. Thoughtful estate planning today can protect your family from unnecessary conflict tomorrow.— Jared W. Heller, Esq.
Estate Planning Isn’t About Death—It’s About Protecting the People You Love
When many people hear the words estate planning, they immediately think about death. While planning for the future is certainly part of the process, estate planning is ultimately about making informed decisions that can help protect the people and assets that matter most to you.
An estate plan allows you to communicate your wishes, identify trusted decision-makers, and organize important legal documents before they are needed. It can also provide guidance for your loved ones during difficult times and help them navigate important decisions with greater clarity.
At Heller Espenkotter, our attorneys work with individuals and families to develop estate plans tailored to their unique goals, circumstances, and priorities.
Why Estate Planning Matters
Estate planning is not limited to retirees or individuals with substantial wealth.
Whether you own a home, operate a business, have children, or simply want your healthcare preferences and financial decisions documented, an estate plan can provide an important legal framework for the future.
Depending on your individual needs, an estate plan may include:
Last Will and Testament
Revocable or Irrevocable Trusts
Durable Power of Attorney
Healthcare Surrogate Designation
Living Will
Beneficiary Designations
Asset Titling Strategies
Each document serves a different purpose and should be prepared based on your personal circumstances and objectives.
Planning Before Problems Arise
One of the greatest advantages of estate planning is the opportunity to make important decisions while you have the ability to do so.
Life circumstances can change unexpectedly due to illness, injury, or other unforeseen events. Taking the time to prepare an estate plan today allows you to document your wishes and designate trusted individuals to act on your behalf if necessary.
Without planning, families may be required to navigate additional legal procedures, and disagreements may arise regarding important financial or personal decisions.
Although every situation is different, thoughtful planning may help provide greater clarity and direction during challenging times.
Understanding Probate
Probate is the legal process through which a deceased person’s estate is administered according to Florida law.
Depending on the assets involved and the circumstances of the estate, probate may include:
Appointment of a Personal Representative
Identification of heirs and beneficiaries
Payment of valid debts and expenses
Distribution of assets
Court oversight when required
Certain planning strategies may allow some assets to transfer outside of probate, depending on how those assets are owned or designated. An attorney can help explain which options may be appropriate for your situation.
Estate Planning and Probate Litigation
Estate planning and probate litigation often involve many of the same legal documents, but from different perspectives.
While estate planning focuses on preparing documents that reflect an individual’s wishes, probate litigation addresses disputes that may arise during estate administration.
These disputes can involve issues such as:
Challenges to a Will
Trust disputes
Questions regarding legal capacity
Allegations of undue influence
Fiduciary disputes
Guardianship matters
Inheritance disagreements
An attorney who has experience representing clients in both estate planning and probate litigation may be able to identify issues that deserve careful consideration during the planning process.
Protecting More Than Assets
Estate planning is about more than distributing property.
It also provides an opportunity to clearly communicate your wishes and establish a legal framework for future decision-making.
Families often face emotionally difficult circumstances following the illness or loss of a loved one. Having clear legal documents in place may reduce uncertainty and help family members better understand your intentions.
Every family has unique dynamics, which is why estate planning should be personalized rather than relying on generic forms or one-size-fits-all solutions.
Estate Planning Should Evolve With Your Life
An estate plan should be reviewed periodically as your life changes.
Common reasons to update an estate plan include:
Marriage
Divorce
Birth or adoption of a child
Purchasing or selling property
Starting or selling a business
Retirement
Significant financial changes
Changes in Florida law that may affect your planning
Regular reviews help ensure your estate planning documents continue to reflect your current wishes and circumstances.
Taking the First Step
Many people delay estate planning because they believe they have plenty of time or assume it is only necessary later in life.
Beginning the planning process allows you to consider your options, ask questions, and document your wishes before unexpected events occur.
An estate plan is not simply a collection of legal documents. It is an opportunity to thoughtfully prepare for the future while providing guidance for the people who matter most.

Denise Sainz – Should You Buy or Wait?
Should You Buy or Wait? Understanding Today’s South Florida Market
By Denise Sainz, MBA
Real Estate Advisor | The Sainz Group
If you’ve been following the headlines, you’ve probably asked yourself the same question many South Floridians are asking:
“Should I buy now, or should I wait?”
It’s a reasonable question. Mortgage rates have fluctuated, inventory has improved in some neighborhoods, and buyers are hearing mixed opinions from friends, family, and social media. The truth is, there isn’t a universal answer. The right decision depends on your financial situation, your long-term goals, and the local market you’re shopping in.
As a Real Estate Advisor serving Hialeah, Miami Lakes, and communities throughout South Florida, I encourage my clients to look beyond headlines and focus on what makes sense for their individual circumstances.
The Market Is Normalizing
After several years of extraordinary market conditions, South Florida is experiencing a more balanced environment.
Many neighborhoods now offer buyers:
More homes to choose from
More time to evaluate properties
Greater opportunities to negotiate
Increased seller concessions in certain transactions
That doesn’t necessarily mean prices are falling across the board. Well-maintained homes in desirable neighborhoods continue to attract strong interest, particularly in communities with excellent schools, convenient transportation, and established amenities.
The key is understanding that today’s market offers more opportunities for thoughtful decision-making than the fast-paced environment buyers experienced just a few years ago.
Waiting Has a Cost Too
Many buyers focus solely on mortgage interest rates when deciding whether to wait. While financing is certainly important, it’s only one piece of the equation.
Waiting may also mean:
Continuing to pay rent without building equity
Missing opportunities on homes that fit your needs
Facing future price appreciation in desirable neighborhoods
Competing with more buyers if interest rates decline
Every month you delay purchasing has its own financial implications, which should be considered alongside financing costs.
Buying Is About Lifestyle—Not Just Timing
Real estate shouldn’t be viewed only as a market decision.
It’s also a life decision.
Are you:
Outgrowing your current home?
Looking for a shorter commute?
Planning to start or grow your family?
Ready to invest in your future?
Relocating to South Florida?
If the answer is yes, those personal factors may be more important than trying to perfectly predict market conditions.
No one consistently buys at the absolute bottom of the market. Successful homeowners often make decisions based on long-term goals rather than short-term headlines.
Every Buyer Is Different
Two buyers can purchase the same home and have completely different financial outcomes based on their financing, savings, long-term plans, and monthly budget.
That’s why I believe every client deserves a personalized strategy rather than generic advice.
Whether it’s evaluating financing options, negotiating seller concessions, or understanding neighborhood trends, informed decisions create greater confidence throughout the buying process.
Hialeah and Miami Lakes Continue to Attract Buyers
Communities like Hialeah and Miami Lakes remain attractive because they offer strong neighborhoods, convenient access to employment centers, diverse housing options, parks, restaurants, shopping, and excellent connectivity throughout Miami-Dade County.
As South Florida continues attracting new residents and businesses, these communities remain desirable places to live and invest in your future.
The Bottom Line
Instead of asking, “Is this the perfect market?”, consider asking:
“Is this the right time for me?”
A well-planned purchase based on your financial goals and lifestyle is often more valuable than waiting for the “perfect” market, which may never arrive.
The best decision is an informed one.
“The best time to buy isn’t determined by headlines—it’s determined by your goals, your finances, and your future.” — Denise Sainz

Raposa Coffee Bets Big on Miami, Bringing Premium Ready-to-Drink Coffee to the Marlins, Heat and Wynwood
Screenshot
After spending 3 years building the brand from New York City through e-commerce and events around the world, Raposa Coffee is officially calling Miami home.
The premium ready-to-drink coffee company recently relocated its U.S. headquarters to South Florida after realizing nearly 95 percent of its customers were already in the United States. Now, it’s leaning into the move with partnerships with the Miami Marlins and Miami Heat, while planning its first U.S. flagship café and roastery in Wynwood, expected to open in early 2027.

“We realized the future of the business was here,” said founder and CEO Andrew Sokolow. “Miami gives us the opportunity to be closer to our customers, build meaningful partnerships, and create a production hub that can serve the entire country.”
Founded in New York City, Raposa Coffee never relied on a traditional storefront. Instead, the company focused on selling online and introducing the brand at conferences and events around the world. It also operated a roasting café in Europe before shifting its focus to the growing U.S. market.
The move to Miami is changing more than just the company’s address.

Rather than roasting overseas and shipping products into the U.S., Raposa will now roast and distribute from South Florida, giving customers a fresher product while streamlining distribution across the country.
Rethinking Ready-to-Drink Coffee
Raposa Coffee continues to grow beyond the café with an expanding portfolio of premium ready-to-drink coffees and teas, reflecting the company’s focus on innovation, convenience and quality. Credit: Raposa Coffee.
Raposa is taking a different approach to canned coffee.
While many ready-to-drink beverages are loaded with sugar, heavy cream and artificial ingredients, Raposa uses specialty-grade Brazilian coffee with vegan ingredients, minimal sugar and no artificial flavors, preservatives or unnecessary additives.
That philosophy has helped the brand find a home in professional sports, where more athletes and fans are looking for cleaner, better-for-you beverage options without sacrificing flavor.
Building a Miami Presence
Raposa products are already available at Miami Marlins games, with availability at Miami Heat games beginning this upcoming NBA season through a multi-year partnership.
The company also recently participated in the X Games in Sacramento and is preparing to open its flagship Wynwood café and roastery in early 2027. The space will serve as both a customer-facing café and the company’s national production headquarters.
Among Raposa’s signature drinks are the Nitro Cookie Dough Latte, Matcha Squeeze and its naturally blue Fightin’ Foam, colored with blue spirulina rather than artificial dyes.
With its headquarters now in Miami, partnerships with two of the city’s major sports franchises and its first U.S. café on the way, Raposa Coffee is betting its next chapter will be built right here in South Florida.
Aileen Martinez: The Power of Financial Clarity
The Foundation of Financial Clarity: Why Every Successful Business Begins with Clean Books
“My favorite part is watching an owner finally see what their money is doing and start actually leading like the CEO they already are.” — Aileen Martinez
Direct Answer: What Does Professional Bookkeeping Provide a Business?
Professional bookkeeping provides the accurate financial foundation that business owners, tax professionals, financial planners, CFOs, lenders, and investors rely on to make informed decisions. Clean books don’t make decisions for a business—they make confident decision-making possible.
Every successful business rests on a solid foundation. Before an entrepreneur hires employees, seeks funding, invests in marketing, expands operations, or prepares for tax season, one thing must come first: accurate financial records.
That belief is at the heart of Aileen Martinez, Founder & CEO of Rise Up Bookkeeping®, a boutique bookkeeping firm providing cleanup and monthly maintenance to service-based online business owners, including coaches, consultants, creatives, practitioners, and other service providers running their businesses online.
With nearly a decade of bookkeeping experience, Aileen now leads a team of seven and has served more than 100 businesses. Those numbers reflect something important about her approach: while every client’s books may be different, the foundation remains the same—accuracy, consistency, and financial records that clearly show what is actually happening inside the business.
In a world where many people assume bookkeeping is little more than entering numbers into accounting software, Aileen has built her career demonstrating something very different. Clean books are not simply organized records. They are the foundation that allows the business owner and the other professionals on the financial team to work from reliable information.
A Passion for Numbers That Never Left
Many career stories begin with someone searching for their passion.
Aileen’s story is different.
She genuinely loved working with numbers from the beginning.
While attending college on a full-ride scholarship and pursuing the ophthalmology track, she worked part-time in bookkeeping to earn additional income. Rather than spending nearly two years searching for a career and eventually discovering bookkeeping, Aileen was already doing the work throughout college.
Over time, she realized that the numbers were where she belonged.
Her education continued alongside that growing passion. Aileen earned her Master of Business Administration (MBA) from Florida International University, expanding the business knowledge that would accompany years of hands-on bookkeeping experience.
Rise Up Bookkeeping®: More Than Data Entry
One of the biggest misconceptions about bookkeeping is that it’s simply data entry.
Aileen has spent her career challenging that perception.
Bookkeeping is the process of organizing, reconciling, and maintaining accurate financial records so that everyone involved in a business’s financial health can rely on trustworthy information.
Aileen believes every business needs a financial team, with each seat filled by someone whose expertise belongs in that particular role.
There may be a tax professional.
A financial planner.
A Chief Financial Officer.
A lender.
And at the center of it all is the business owner—the CEO—making decisions about the future of the company.
Aileen’s role isn’t to replace any of those professionals or tell the owner what decisions to make.
Her seat is the foundation.
She makes sure the books are clean and that the numbers accurately show what is happening in the business. Those numbers can then go to the tax professional, financial planner, CFO, lender, or other appropriate professional so each can do their job using real data rather than guesses.
Just as you can’t build a house on a rocky foundation, a business shouldn’t try to build its financial future on unreliable books.
The Green Checkmark That Changed Everything
One client forever changed how Aileen understood the potential impact of clean bookkeeping.
The client had more than 10 financial accounts requiring cleanup going back approximately three years—and she needed the work completed quickly.
It was a significant project.
Aileen remembers reconciling the final account.
The balance reached zero.
The little green checkmark appeared.
She had finished the entire cleanup in less than 30 days.
Aileen handed the completed books back to her client, who later returned with exciting news: she had secured $150,000 in funding from investors.
Aileen is careful about what happened next.
Her bookkeeping did not get the client the funding.
The entrepreneur earned that investment based on the strength of her business and business model. What the clean books did was allow the investors to clearly see where the business stood financially and where it was going.
Once the funding arrived, the owner could also use her own numbers to determine how the money should be allocated rather than simply following what other businesses were doing.
That experience forever shaped how Aileen viewed her work.
As she puts it:
“A business is really a series of decisions. Whether it works comes down to where those decisions are coming from: your own numbers, or what everybody else is doing.”
Building a Business While Earning Her MBA
Aileen launched Rise Up Bookkeeping® in January 2021 while simultaneously completing her MBA.
She graduated in April 2021.
By January 2022, within 13 months of launching the company and approximately nine months after graduating, Rise Up Bookkeeping® had reached six figures.
Today, the company has grown beyond Aileen herself. She leads a seven-person team and brings nearly a decade of bookkeeping experience to a firm that has now served more than 100 businesses.
Her clients aren’t limited to Miami or even Florida. Aileen has worked with businesses across the United States, including clients in Florida, Maryland, New York, California, Alaska, and beyond.
The Multipreneur Behind the Numbers
Aileen understands the realities of business ownership because she lives them herself.
In addition to Rise Up Bookkeeping®, she is the co-founder of Sori Martinez Online Notary & Apostille Services, a mother-daughter business she built alongside her mother.
That makes “multipreneur” a particularly fitting description.
And behind the businesses is another important part of Aileen’s life.
She is a proud wife to her husband, Kyle, and mother to their three children.
Building companies while raising a family requires adaptability, discipline, and an understanding that success doesn’t happen in only one part of life.
A Woman of Service
Service has long been central to Aileen’s personal and professional identity.
Years before launching Rise Up Bookkeeping®, assessments she completed while pursuing her education identified characteristics including being results-oriented, helpful to others, and observant. She described the common thread herself as being “a woman of service.”
Today, that service extends beyond her businesses.
Aileen sits on the board of The Seizing Happy Foundation™, a nonprofit whose mission is helping women of color reach financial success through entrepreneurship by removing barriers and building a support network around them.
That same desire to educate and inspire appears in her public speaking.
Aileen doesn’t approach the stage to tell entrepreneurs what decisions they should make. Instead, she inspires, provokes action, and walks audiences through practical frameworks they can apply for themselves.
Her long-term vision includes becoming a nationally recognized keynote speaker.
Financial Clarity Creates Better Leadership
Business owners often hear the phrase “financial clarity,” but what does it actually mean?
For Aileen, it means understanding what your business is actually doing—not what you hope it is doing, and not what someone else on social media says your business should be doing.
It begins with clean books that accurately reflect reality.
Those reports then belong to the business owner.
The owner can use them when working with a tax professional, financial planner, CFO, lender, or another member of the financial team. More importantly, the owner can look at the numbers and lead the company based on what is actually happening inside their own business.
That’s an important distinction.
Aileen isn’t making the decisions.
She’s making sure the foundation beneath those decisions is accurate.
“Without data, you’re just another person with an opinion.” — W. Edwards Deming
Few quotes capture the importance of bookkeeping more accurately than this observation attributed to W. Edwards Deming. Every business is ultimately a series of decisions, and the quality of those decisions depends heavily on the quality of the information available. Trends, social media, competitors, and other entrepreneurs may provide inspiration, but none of them can tell an owner exactly what is happening inside their own company.
That’s where Aileen’s philosophy comes full circle.
She doesn’t tell business owners how to run their companies. She ensures that the books accurately document what has already happened financially. Those records become a common language that can be used by the owner and shared with tax professionals, lenders, investors, financial planners, CFOs, and other members of the financial team.
The story of the client who secured $150,000 in investor funding illustrates the distinction perfectly. The books didn’t create the opportunity, and the bookkeeper didn’t make the business successful. The entrepreneur built the company and earned the investors’ confidence. Clean books simply allowed the financial reality of that business to be seen.
Nearly a decade into her bookkeeping career, after serving more than 100 businesses and building a team of seven, Aileen continues to occupy that foundational seat.
Looking toward the future, she hopes to bring the same message to larger audiences as a nationally recognized keynote speaker: entrepreneurs should understand their own businesses, know their own numbers, and confidently occupy the CEO seat.
Because opinions can inspire a business owner.
Their own numbers tell them what’s actually happening.
The Takeaway
Behind every successful business is a series of decisions, and behind informed decisions should be reliable information.
That’s the role Aileen Martinez proudly fulfills.
Through Rise Up Bookkeeping®, she and her team help service-based online business owners establish and maintain the bookkeeping foundation their businesses and financial professionals can rely upon.
She isn’t there to replace the accountant, tax professional, financial planner, CFO, or business owner.
She makes sure they have clean books to work from.
Because every great business deserves a strong foundation.

When Banks Say No, Experience Says Yes
Commercial Lending Experience: 50+ Years That Make the Difference
“Banks finance numbers. We finance possibilities by understanding the story behind those numbers.” — Errol Eisinger
TL;DR – Commercial Lending Experience Matters
Commercial lending has become increasingly complex, but a loan denial does not always mean the opportunity is over. With more than five decades of commercial lending experience in commercial real estate and banking, Errol Eisinger helps condominium associations, investors, and business owners find financing solutions by matching each opportunity with the right lender instead of forcing every borrower into the same lending model.
When Banks Say No, Commercial Lending Experience Says Yes
Hearing the word “no” from a bank can be discouraging, especially when a project is well planned and financially sound. Yet in today’s lending environment, many loan denials have less to do with the quality of the borrower and more to do with increasingly restrictive lending guidelines. That is why commercial lending experience has become one of the most valuable assets in commercial financing.
Commercial Lending Experience and the Complete Financial Story
Direct Answer: When a traditional lender declines a commercial real estate or condominium loan, an experienced lending professional may still be able to structure financing through specialized lenders, private capital, or alternative banking relationships. The key is understanding the complete story behind the transaction rather than relying solely on automated underwriting standards.
Few professionals understand that reality better than Errol Eisinger, whose career spans more than fifty years in commercial real estate and finance. His journey began as Comptroller for a major South Florida commercial and residential real estate company, where he worked alongside one of the region’s most respected commercial brokers and investors. That foundation led him into banking, where he served as a Commercial Real Estate Loan Officer, giving him a unique perspective from both the borrower’s and the lender’s side of the table.
Finding the Right Lending Partner Through Experience
What separates experienced lenders from traditional institutions is not simply access to capital. It is the ability to evaluate opportunities that fall outside conventional lending guidelines. A condominium association dealing with reserve funding, an investor purchasing a distressed property, or a developer facing documentation challenges may all appear risky on paper. However, those same projects often become financeable when evaluated by someone who understands the complete financial picture.
Throughout his career, Eisinger has learned that every lending institution has its own strengths. Rather than submitting every loan to the same bank, he works with a network of specialized lenders, matching each transaction with the institution most likely to understand its unique circumstances. That strategic approach saves valuable time while increasing the likelihood of approval.
Commercial Lending Experience for Condominium Associations
His expertise extends beyond banking relationships. Having served as both a board member and president of a condominium association, Eisinger understands the challenges communities face from the inside. Deferred maintenance, reserve requirements, special assessments, board transitions, and collection issues all create financial obstacles that require practical solutions, not simply policy manuals.
Commercial Lending Experience in Commercial Real Estate
Commercial real estate investors face similar challenges. Strong opportunities are sometimes overlooked because of temporary credit issues, incomplete financial documentation, property condition, or market uncertainty. Traditional lenders often see those factors as reasons to decline an application. Experienced commercial lenders see them as challenges that can often be addressed through creative financing strategies.
A Commercial Lending Philosophy Built on Experience
One philosophy has remained constant throughout Eisinger’s career:
“Banks finance numbers. We finance possibilities by understanding the story behind those numbers.”
— Errol Eisinger
That perspective reflects more than five decades of commercial lending experience working with borrowers, investors, condominium associations, and financial institutions. It recognizes that successful lending requires more than reviewing financial statements. It requires understanding people, properties, markets, and long term objectives.
Today’s Changing Commercial Lending Environment
Today’s lending environment continues to evolve. Regulatory requirements have increased, underwriting standards have tightened, and many financial institutions have become more conservative in their decision making. According to the Consumer Financial Protection Bureau, borrowers benefit from understanding all available financing options before assuming a project cannot move forward. Alternative lending strategies have become an increasingly important part of the commercial real estate landscape.
Why Commercial Lending Experience Matters After a Rejection
The lesson is straightforward. A rejection from one lender should never be interpreted as the final answer. Different lenders evaluate risk differently, and experienced professionals know where opportunities are most likely to fit.
As Henry Ford famously said, “Failure is simply the opportunity to begin again, this time more intelligently.” That quote perfectly reflects commercial lending. A declined application is often not the end of the process. Instead, it becomes the beginning of finding a better path with a more appropriate lending partner.
The Value of Commercial Lending Experience
The most important takeaway is this: financing is not only about interest rates and balance sheets. It is about relationships, knowledge, persistence, and experience. Those qualities cannot be automated, and they often make the difference between a project that stalls and one that succeeds.
If your condominium association, commercial investment, or development project has encountered financing challenges, do not let one decision determine your future.
